<br />The UIC area permit governing these wells, at part II(E)(2), requires that wells must be <br />plugged after determining that such wells no longer have any useful purpose. Further, the area <br />permit, at part III(E)(6), requires NS to furnish. to EPA upon its request, information necessary to <br />determine compliance status. <br />Pursuant to the permit at part II(E)(2), as reiterated in the regulations at Title 40 of the <br />Code of Federal Regulations, Section 144.51(h), EPA requests that NS supply information <br />answering the enumerated questions below within 30 days of receipt of this letter. <br />1. What is the status of the 7H-2I and 7H-1R wells? <br />2. If NS has determined a useful purpose for these wells, what is the timeframe NS has for <br />implementing such purpose? <br />3. If NS has. reached a decision that these wells will serve no useful purpose, when will NS <br />plug and abandon these wells? <br />If NS chooses to plug and abandon these wells, a plugging and abandonment plan must <br />be submitted to EPA for approval prior to the plugging operation. <br />Failure to comply with the UIC regulations found at 40 CFR Parts 144 through 148 <br />constitutes orie or more violations of the Safe Drinking Water Act, 42 U.S.C. §300h. Such non- <br />compliance may subject you to formal enforcement by EPA, as codified at 40 CFR Part 22. <br />If you have any questions or comments concerning this letter, you may contact Ken <br />Phillips at (303) 312-6405.
