At the hearing in this matter, Mr. Erickson informed the Board that the <br />Division did receive the required financial warranty within one calendar year, but it was not <br />executed properly and the financial warranty was returned to the Applicant. By the time the <br />Applicant returned the financial warranty one calendar year had expired. <br />6. At the hearing in this matter, Ms. DeVincentis informed the Board that an <br />individual involved in these proceedings had passed away, which had added to the confusion <br />and had delayed the Applicant's submittal of the financial warranty. Ms. DeVincentis <br />informed the Board that Western Gravel intended to eliminate the potential for continued <br />confusion by transferring the permit for Western Gravel as successor operator in the <br />immediate future. <br />7.
