III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Yoast Mine conducted on December 03, 2007 by Mike <br /> Boulay of the DRMS. Dennis Jones of Seneca Coal Company(SCC) was present during the <br /> entire inspection. Weather conditions were cloudy and cold. Ground conditions at the mine site <br /> were snow covered from a recent snow storm that passed through the area during the weekend <br /> prior to this inspection. There was no activity at the mine site at the time of the inspection. <br /> Availability of Records <br /> All required records were on file and available for review at the mine office. Please see the <br /> Availability of Records checklist at the end of this inspection report. <br /> Roads <br /> Most of the mine site was not accessible due to snow packed road conditions. Haul Road A was <br /> impassable because it had not yet been plowed. Road berms and ditches along Haul Road A <br /> were all snow covered. Portions of the North Pit could only be viewed from County Road 27 and <br /> appeared heavily covered in snow. The county road along Sage Creek on the west side of the <br /> Yoast Mine had recently been plowed. The county road was muddy and icy but was accessible <br /> all the way to Pond 014. The access road to Pond 011 was not plowed and was inaccessible. No <br /> other areas of the mine site were inspected due to the poor road conditions. <br /> Hydrologic Balance <br /> Sedimentation Ponds 012, 013, and 014 were inspected. Pond 012 was discharging clear water. <br /> Ponds 013 and 014 were not discharging. Pond inlets and embankments at all sediment ponds <br /> were snow covered. No problems were noted at any of these sediment pond locations. <br /> Slides and Damage <br /> The location of the slide repair area above Pond 012 was inspected from the county road. As <br /> shown in the attached photograph, the site of the slide is stable. As requested during the October, <br /> 2007 inspection SCC replaced topsoil that had eroded from the hill slope during a recent <br /> rainstorm. As seen in the photo the slope is entirely snow covered but the topsoil replacement <br /> remains stable and intact. As part of the repair SCC also constructed a channel on the west end <br /> of the slide repair area to direct runoff into Pond 012. If this is intended to be a permanent <br /> channel, please submit to DRMS a design and profile of the channel for incorporation into the <br /> permit document. <br />
