M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the Seneca II Mine conducted on December 3, 2007 by Mike <br /> Boulay of the DRMS. Dennis Jones of Seneca Coal Company(SCC) was present during the <br /> inspection. Weather conditions were cloudy and cold. The majority of the mine site was snow <br /> covered. There was no activity at the site during the inspection. <br /> Roads <br /> The permanent road accessing the mine site(Road El)had not been bladed or plowed. The <br /> Road E to the Pecoco Pond was plowed only a short distance beyond the facilities area. Road <br /> ditches and accessible culverts were completely snow covered. The majority of the mine site was <br /> not accessible due to drifted snow and snow packed road conditions. <br /> Hydrologic Balance <br /> Site Sedimentation Ponds 002 and 003 were viewed and the truck wash ponds were inspected. <br /> The surface of Ponds 002 and 003 were partially frozen over. Both of these ponds were full, and <br /> discharging. The truck wash settling pond was retaining only a small amount of water and was <br /> not discharging. The embankment of the truck wash supply pond was breached and the pond <br /> was drained to the perimeter ditch that flows to Pond 003. This was done so that SCC could <br /> remove two submersible pumps that were no longer in use at the supply pond and were needed <br /> elsewhere by SCC. According to SCC, this is a temporary condition and the embankment will be <br /> replaced. To ensure compliance, please ensure that the embankment is re-compacted. Neither <br /> the truck wash supply nor settling ponds have been approved as permanent structures, and <br /> according to the approved plan these facilities will eventually be reclaimed. Since the <br /> embankment at the supply pond has been breached this may be a good time to go ahead and <br /> reclaim the pond now. <br /> Support Facilities <br /> The new boneyard and the shop/facilities area were the only locations that had been cleared of <br /> snow and were the only locations accessible during this inspection. Perimeter areas at these site <br /> locations were well maintained and no problems were noted. SCC has removed all of their <br /> property and trash items from both the new and old boneyard locations. The old boneyard area <br /> has been fully reclaimed. <br />
