IV. ENFORCEMENT ACTIONS <br /> The following identifies enforcement actions taken during this inspection, the required abatement and <br /> date of abatement for the violation, previous violations still requiring abatement and the termination of <br /> violations cited during previous inspections. <br /> Notice of Violation CV-2007-006 <br /> Notice of Violation CV-2007-06 was issued for failure to confine surface coal mining and reclamation <br /> operations to lands within the permit area. Topsoil-like material and excess rock were transported from <br /> the Hubbard Creek vent shaft construction site to the Paonia Water Pollution Control Facility, which is <br /> not the approved plan. The topsoil-like material should have been stockpiled within the Bowie No. 2 <br /> permit area and the excess rock should have been transported to the Bowie No. 1 East Mine for <br /> permanent storage as approved in MR-83 for Bowie No. 2 and MR-119 for Bowie No. 1. The two <br /> abatement steps are: <br /> 1. Transport topsoil-like material from the Paonia Water Pollution Control Facility to the Hubbard <br /> Creek vent shaft construction site for storage or to another topsoil storage area approved by the <br /> Division through a minor revision. Field Minor Revision No. 84 was approved so that the topsoil-like <br /> material from the Paonia facility or from the Hubbard Creek vent shaft construction site can be <br /> stockpiled at the Bowie No. 2 unit train loadout main topsoil stockpile. The due date for abatement is 5 <br /> pm on November 23, 2007. <br /> The field inspection of December 5, 2007 verified that the topsoil-like material was transported <br /> to the main topsoil stockpile at the Bowie No. 2 unit train loadout. The operator was beginning <br /> to seed the topsoil addition and cover it with erosion control matting. Therefore, step one has <br /> been abated. <br /> 2. Transport excess rock to the Bowie No. 1 Mine as approved in Minor Revision No. 83 or obtain <br /> Division approval through a technical revision to keep the excess rock at the Paonia facility. The due <br /> date for abatement is 5 pm on December 17, 2007. <br /> The Division received Technical Revision No. 51 on December 10, 2007 in which Bowie <br /> Resources is seeking approval to keep the excess rock material at the Paonia Water Pollution <br /> Control Facility.
