III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the inspection.The site had received a recent precipitation event. The site was a little wet but there was <br /> no snow on the ground. <br /> Unit Train Loadout <br /> The operator was doing some backfill work around the former coal silo area, using an excavator. The area had <br /> been re-disturbed when the silos were demolished. There was no other activity at this site during the inspection. <br /> A string of empty railcars was on the spur line track. <br /> The three entrances to the loadout site were open,with a mine ID sign up at each location.The three paved <br /> entrance haul roads were in good condition.There were no problems with any of the mine equipment that is <br /> being stored on site or with the remaining loadout facilities. The topsoil stockpile was well vegetated and the <br /> topsoil stockpile sign was up. <br /> There was no standing water in the sediment pond. The bin wall of the sediment pond appeared to be stable. The <br /> diversion ditch and culverts above the pond were functioning properly. The upland diversion ditches and <br /> culverts at the center of the loadout site were also properly functioning. The west side collection ditch and half <br /> culvert drop structure were in place.The berm on the outside edge of the loadout bench was in place. <br /> The operator continues to draw down the stockpile of crushed gravel-sized concrete that came from the <br /> demolition of the three coal silos. <br /> Highway Coal Stockpile <br /> This site was a former coal stockpile area. The coal had been removed and the area covered with soil and <br /> vegetated to keep down any fugitive dust. The site still needs to be reclaimed. There were empty rail cars on the <br /> spur line track. <br /> The mine ID sign was up at the entrance to this site.The required information was on the sign. Surface <br /> disturbance markers delineated the disturbed area. <br /> The road into the site was muddy but passable. There was some ice-covered water in the sediment pond,but the <br /> ice level was several feet below the top of the pond. <br /> The site had positive drainage since the site was wet but there were no pools of standing water. The cut slopes <br /> were stable, with no evidence of slope erosion. <br /> c:/word/bowie 1/insp 1207 <br />
