• September 23, 1999 <br />To Whom It May Concern, <br />Recently, we negotiated a lease with National King Coal, LLC to mine coal which is <br />beneath the surface of land which is owned by us more particularly described as follows: <br />Section 5: E/2 SW/4, W/2 SE/4; T34N, R11W N.M.P.M. <br />Part of the permitting process, they informed us, requires that an archaeologist perform a <br />survey to document any cultural resources which may be found on our property. <br />I feel that since this is an underground mine, there will be little chance for significant <br />surface disturbance. I do not wish to have any kind of archaeological survey done on <br />surface lands owned by me and will prohibit anyone from entering my property to do so. <br />This letter also serves to give permission to National King Coal, LLC staff to enter (with <br />prior written or verbal notice) the property mentioned above for the purpose of any <br />examinations required by law such as subsidence monitoring, surveying, etc. <br />• Sincerely, <br />~~~ ~ y <br />~ ~ <br />Richard Tipotsch <br />for: Richard Tipotsch, et al <br />• <br />
