2.03.7 -RELATIONSHIP TO AREAS DESIGNATED UNSUITABLE FOR MINING <br />The permit area does not lie within an area which has been designated unsuitable <br />for mining as attested by the attached excerpts from B.L.M. entitled APPENDIX I <br />Unsuitability Analysis and Report. Data prepared for Emergency Coal Lease <br />Application (C-29125) dated October 16, 1979 and amended July 9, 1980; and data <br />prepared for Lease Modification Application (P-058300 and C-29125) dated April 27, <br />1988 and amended October 12, 1988. (See Appendix 1 in King Coal Mine permit <br />document) <br />No portion of the lands within the proposed permit area are within an area <br />designated unsuitable for surface coal mining operations under Rule 7 or 30 CFR <br />764 and 765, nor under study for designation in an administrative proceeding under <br />Rule 7 or 30 CFR 764 and 765. <br /> <br />No dwelling sites are located on or within 300 feet except the Marc and Julie <br />Crawford residence as shown on Map King I-005. <br />Map 2 of Final Coal Unsuitability Report: Analysis of Three Potential Lease Areas <br />(Durango, E. Cortez and Nucla) published by B.L.M. and included in this application <br />indicates that no portion of the permit area is within an area designated unsuitable <br />for mining.
