specimen or specimens would not be seriously <br />• damaged or destroyed by the activity. The Regional <br />Director or the District Mining Supervisor, as <br />appropriate, shall evaluate or have evaluated such <br />discoveries brought to his attention and, within <br />five (5) working days, shall notify the lessee <br />what action shall be taken with respect to such <br />discoveries. <br />(4) All such fossils of significant scientific <br />interest shall remain under the jurisdiction of the <br />United States until ownership is determined under <br />applicable law. Copies of all paleontological <br />resource data generated as a result of the lease <br />term requirements will be provided to the Regional <br />Director or the District Mining Supervisor, as <br />appropriate. <br />(5) The cost of any required salvage of such <br />fossils shall be borne by the United~States. <br />(6) These conditions apply to all such fossils of <br />significant scientific interest discovered within <br />the lease area whether discovered in the <br />overburden, interburden, or coal seam or seams. <br />• B. Alternative 2-No Action <br />If the proposed modification were not issued, National <br />King Coal would be precluded from mining the coal in the <br />proposed modification area. National King Coal would not <br />have access to the additional coal reserves which would <br />shorten the mine life to approximately six years. It is <br />anticipated that coal production, employment and truck <br />traffic would remain the same as the proposed action <br />throughout the remaining life of the mine. If the <br />proposed modification is not issued the mine would <br />probably close in approximately five (5) years. <br />III. AFFECTED ENVIRONMENT <br />A detailed description of the existing environment can be <br />found in the San Juan/San Miguel Resource Management Plan <br />(RMP). Specific resources that may be affected as a result of <br />the proposed action are detailed below. <br />• 8 <br />
