down to Road E1; a final traverse was made along the central portion of the bond release area from <br />north to south above Road E 1. The Division's observations and findings are described below under <br />the following broad headings: Grading & Site Stability, Topsoil, Revegetation, and Excluded Areas <br />(not meeting the requirements for bond release). <br />Grading & Site Stabili <br />The reclaimed Pre-Law lands included in the bond release area were stable with no significant erosion <br />noted. The site was graded to be appropriate for the post-mining land use, which includes a primary <br />postmining land use of livestock grazing and a secondary use of wildlife habitat. Cattle were seen <br />grazing throughout the Pre-Law area. The steepness of representative slopes was field measured with <br />an inclinometer along two traverses from the top of the bond release area down to Road E1. Slopes <br />measured ranged from 20% to 42% with the steeper terrain being at the higher elevations of the bond <br />release area. A representative cross-section across the central portion of the Pre-Law area was <br />surveyed and constructed by SCC and is provided as Exhibit F of the bond release application. There <br />is good topographic diversity with a significant amount of hilly terrain. The reclaimed landform is <br />stable and slopes are not too steep to be traversed by livestock. Photograph Numbers 1 & 2 provided <br />in Attachment 1 at the end of this document show cattle grazing on the stable well vegetated <br />reclaimed area. <br />Surface runoff control appears adequate with no significant rills and gullies noted anywhere in the <br />bond release area. There are no post-mine drainage channels constructed in the bond release area <br />with exception of the extreme lower section of PL-1 described below under the discussion of <br />excluded areas. There is one sediment pond (Pond 002) and no stock ponds within the reclaimed <br />259.1 acres requested for bond release. Surface runoff all eventually drains to the Wadge <br />Impoundment -Pond 002, which is included in the Pre-Law Area and has been approved by the <br />DRMS as a permanent structure. Sedimentation Pond 002 is shown on Exhibit A of the bond release <br />application and in the PAP on Exhibit 7-19, Postmining Drainage Control and Exhibit 13-2A, <br />Postmining Topography and Permanent Features. SCC submitted a permanent impoundment <br />demonstration and letters from all appropriate landowners requesting that the pond be left in place as <br />permanent. The permanent impoundment demonstration along with an As-Built Certification was <br />approved with Technical Revision No. 37 on September 12, 2006. The permanent impoundment <br />demonstration is given in Appendix 7-6a, the As-Built Report is provided in Appendix 7-6a.1, and <br />landowner requests for permanent structures is provided in Appendix 13-12a of the PAP. Future <br />management of the pond is described in Appendix 7-10. <br />There were three separate sections of haul road that traversed the 259.1 acres requested for bond <br />release. Two of these have been fully reclaimed. These former haul road sections are stable with no <br />erosion and have adequate vegetative cover. Amain section of haul road traversing the central <br />portion of the area is shown in Photograph Number 3. The lower haul road which still crosses <br />through the Pre-Law lands was retained and subsequently used during the permanent program time <br />frame and was designated as Road E 1. This road has been approved by the DRMS as permanent and <br />was not part of this bond release inspection. <br />
