III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> There has been some recent disposal of coal waste from the South Mine area on the open portion of CRDA-1. <br /> A portion of.the recently placed material has been graded, and there is approximately 400 cubic yards of loose <br /> dumped material that has not yet been graded. Adjacent reclaimed slope areas had been properly scalped of <br /> cover soil to allow sufficient room for placement and grading of the new waste material. Appropriate measures <br /> had been taken to maintain proper surface drainage during active dumping and grading operations. Upon <br /> completion of waste material haulage from the South Portals, the waste will need to be properly graded and <br /> compacted, with design drainage restored. Compaction test documentation will need to be provided. Future <br /> disposal of coaly material from the Unit Train Loadout is anticipated within this designated portion of CRDA-1. <br /> Support Facilities <br /> The Division previously approved a technical revision application to allow use of the rail loadout by another entity <br /> (Halliburton)for storage, loading and unloading of specified construction materials. Halliburton has completed <br /> some grading adjacent to the rail siding and set up a portable loader/conveyor. Tonya Hammond indicated <br /> Halliburton had recently operated the conveyor to off-load materials. <br /> The North Portal (Cameo)substation and remaining powerline structure between the substation and the loadout <br /> will be reclaimed in conjunction with reclamation of the loadout facility, anticipated during 2008/2009, pending <br /> approval of PR-4,which is currently under review. Transformers were previously removed from the substation. <br /> The Substation "A" site was properly reclaimed and silt fenced earlier this year. There are some remnant power <br /> pole sections at this site that will need to be removed. <br /> Revegetation/Reclamation Success <br /> Revegetation success was not closely evaluated, due to season. The North Decline area was checked for <br /> recent seedling emergence from the February 2007 interseeding. Results are so far not encouraging. <br /> 5 <br />
