i <br /> M. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.Jim Kiger represented the <br /> Terror Creek Company. There were no recent precipitation events and the temperatures have been cool. <br /> Facilities <br /> One coal haul truck unloaded during the inspection.No fugitive dust problems were evident.No railcars were <br /> being loaded during the inspection but no fugitive dust was observed from the already loaded railcars that were <br /> still on site. The three coal stockpiles were small in volume and had no problems with fugitive dust as well. <br /> There was a little black stain on the highway at the main entrance but it did not appear to be a problem. <br /> No problems were observed at the mine office, shop, substation,material storage area,fuel facility, coal <br /> screening structures or the coal unloading and loading facilities. <br /> H, drologX <br /> The ditches at the loadout had sufficient capacity. The culverts were clear and functional. The silt fence and <br /> straw bales along the railroad track small area exemption were in place. <br /> The east side sediment pond had a little standing water in it, but well below the level of the discharge pipe. The <br /> gated valve on the pipe was closed and the riprap was in place on the emergency spillway outslope. The pond <br /> embankment was stable.The west side dugout pond was dry. The spillway was functional. <br /> Topsoil Stockpiles <br /> The east side topsoil stockpile had a good vegetative cover. The collection ditch and the diversion ditch had <br /> sufficient capacity. The west side topsoil stockpile also had a good cover of vegetation. The diversion/collection <br /> berm was in place. Topsoil signs were up on both topsoil stockpiles. <br /> Signs and Markers <br /> The mine ID signs were up at the main entrance, east entrance and near the tracks. Sign information was correct. <br /> Perimeter markers were up along the permit boundary. <br /> Roads <br /> The paved haul road was in good condition. Guard rail was up. The east side graveled entrance road also was in <br /> good condition. The light use road along the tracks was in good condition. Low spots in the road had been filled. <br /> Records <br /> The required mine records were in compliance,as shown on the attached records checklist. <br /> c:/word/terror/insp 1107 <br />
