DRMS cannot approve an application without an adequate financial warranty in place (see Colorado <br />Revised Statutes Section 34-32-177(1)). The bond will be calculated based on all the pertinent tasks <br />required to reclaim the site to the proposed post mine land use. Due to the fact that the site is on Bureau <br />of Land Management lands they must concur on the reclamation liability estimate prior to final <br />acceptance by the Division. All operators holding permits must maintain an adequate bond for the life <br />of the mine and failure to do so may be a violation of the Act and Rules. <br />INFORM has brought up the issue of possible temporary cessation (TC) violations at the Packrat and <br />Urantah (Liberty) Mines. Both mines have been reclaimed and released by the DRMS and therefore, the <br />DRMS has no jurisdiction over them with regards to TC. <br />An adequacy letter has been sent to Energy Fuels for their review and responses and a copy is enclosed <br />with this letter. Energy Fuels will have to submit their reply by December 14, 2007 in order for staff to <br />have adequate time for review. If all issues are addressed ~er Rule 2.0 the following tentative schedule <br />is set based on the present Decision Date of December 24t , 2007. <br />On or before December 24, 2007 Division will issue "Letter of Rationale" (Rule 1.4.9(c)). <br />December 28, 2007 Pre- Hearing Conference (PHC), Grand Junction <br />3 working days after Letter of Rational (Rule 2.7.1(5)) <br />January 2, 2008 All Motions filed with the Board <br />2 working days after PHC (Rule 2.6 (1)) <br />January 4, 2008 Written responses to all motions filed with Board (Rule 2.6 (1)) <br />3 working days prior to Board Hearing (Rule 2.6 (1)) <br />January 910, 2008 MLRB Hearing, Denver <br />165 days after submission of complex application. <br />Please be aware that per Rule 1.4.1(9) the applicant can extend the review time for up to 365 days from <br />the date the application was considered filed. <br />If you need additional information, please contact me at the Division of Reclamation, Mining and <br />Safety, Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, <br />telephone no. 970.241.1117. <br />Sincerely <br />G.
