A global search will be made of the Plan of Operations and the recommended revision <br />will be made as requested. <br />19. Any statements proposing to build safety berms with salvaged topsoil should be <br />revised to state: <br />Berms will be constructed of waste rock due to limited topsoil resources. <br />The recommended change will be made on the waste rock pile; however, Energy Fuels <br />would like the option of continuing to use the material scraped off the Packrat Road for <br />the road's berms. This material is not true topsoil, but rather gravel and subsoil material <br />that was vegetated during previous reclamation activities. The reclamation plans calls for <br />_ . _ pulling this material plus additional soil that was historically cast down the side of the hill <br />back up the slope during reclamation to create a surface that better blends-with the - - <br />surroundings. The soil berm can be seeded during operations to minimize erosion and <br />weeds, and create an improved growth media for final reclamation. <br />20. Any statements made proposing awire-rope gate restricting access on the Packrat <br />should be revised to state: <br />The roads into the both the Whirlwind and Packrat mines areas will have <br />swinging/lockingrnetal gates. <br />A global search will be made of the Plan of Operations and the recommended revision <br />will be made as requested. <br />21. Statements made concerning reclamation goals with vegetation should say: <br />Disturbed areas will be considered satisfactorily revegetated when the percent <br />vegetative cover at least equals the cover percent prior to disturbance and the plant <br />species composition is as least desirable as that present prior to disturbance (BLM <br />1987). This will be defined more clearly through baseline studies and the environmental <br />assessment process. <br />This change will be made in Exhibit 6.21. However, the change will not be made in the <br />112d application to DBMS, as the state generally requires 90 percent of the original <br />cover. It may be desirable to run several transects of undisturbed areas in late spring or <br />early summer 2008 to accurately document current cover percent and plant species <br />composition. We can include this vegetative survey in the Plan of Operations, if desired. <br />We anticipate receiving DRMS comments this week and hope to have all the requested <br />revisions made to the Plan of Operations and resubmitted to you in mid December. Please <br />call or a-mail me with any questions or concerns that you may have.
