We are still waiting on comments from the Colorado Division of <br />Reclamation, Mining and Safety (DBMS) and would prefer to update both the Plan of <br />Operations and the DBMS 112d Reclamation Plan at the same time. Although the Plan of <br />Operations and 112d Reclamation Plan are formatted differently, they are consistent with <br />each other and we want to keep it that way to the extent possible. We believe that if we <br />revise each plan at the same time in response to both sets of comments, the two plans will <br />continue to be consistent with each other and accurately represent our plans for the <br />project. <br />We have listed your questions in italics and our responses in regular font below. The <br />revisions to the Plan of Operations will be submitted at a later date once we receive and <br />review comments from the DBMS. The revisions will be submitted as replacement pages. <br />For ease of reference, we will also include one set of replacement pages with all of the <br />revisions highlighted. <br />1. Freshwater source (Page 5 - 23). This indicates that the freshwater source would be <br />nearby springs or wells. However, the recent bulk sampling NOI says DP Spring will not <br />be used. Specify your likely freshwater source. <br />Completion of a potable water well at the project site is not an option because the nearest <br />ground water in the lower Salt Wash formation is of poor quality and the cost to sink a <br />deep well is prohibitive. To date, Energy Fuels has trucked its water to the project from <br />its offices in Nucla. We plan to contact the owners of the water rights for nearby DP <br />Spring (K. Hubbard and J.
