These comments were dated October 10, 2007 and were received by DBMS <br />on October 11, 2007. Based on the nature of the comments, DBMS has classified them as <br />an objection to the permit. <br />In reviewing your comment letter, it appeared that you were requesting that the DBMS be <br />thorough in their review; however, we did not fmd any specific objections to our <br />application. Below, we have responded to the concerns that you expressed in your letter <br />that appear to be within the regulatory purview of DBMS. Hopefully, the environmental <br />control measures that we have proposed will reduce your concerns regarding the project. <br />We have also attempted to provide clarification, where appropriate, regarding both the <br />project and regulatory requirements. <br />Your comments are in italics and our responses are in standard font. <br />Comment 1 <br />We would like to offer our support for DMO designation of the Whirlwind Mine and the <br />resulting heightened regulatory scrutiny required for DMO mining operations.
