III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns and Jason Musick of Colorado Division of <br /> Reclamation, Mining and Safety. The mine is a reclaimed surface mine. The weather was cloudy, mild <br /> and dry. <br /> Roads: The access road to the facilities area was dry and in good shape. Rock check dams along the <br /> access road ditch remain in good repair with the exception of the southernmost rock check dam. This <br /> southernmost rock check has additional runoff directed into it from the west and requires additional <br /> maintenance. <br /> The access road to the load out is maintained in fair condition. Recent grading of the loadout access road <br /> had removed sediment from the pavement and reshaped the roadside ditches. <br /> Offsite Support Facilities: The loadout pond was discharging clear water, approximately 0.03 on the staff <br /> gauge at the weir. Aquatic vegetation in the pond has died back. Vegetation on the loadout was in good <br /> condition. The warehouse building has had new boards affixed to the windows,the garage doors have <br /> been closed and the building is in overall fair condition. <br /> Hydrologic balance: . Pond A, B, D and E were holding pools of water but were not discharging. Water <br /> pools were partially frozen. Pond F was dry and in good repair. Repair to ditch PD3 remains in good <br /> condition. Pond embankments and hydrologic control ditches are in good repair and adequately <br /> vegetated. <br /> Revegetation: The ground surface was dry and clear of snow. Concerns were noted regarding vegetative <br /> cover in the Southwest portion of Pit 1 during the October 23, 2007 bond release inspection. This area <br /> was revisited. Rills appear to be approximately 4-6 inches deep and of limited extent. Though <br /> vegetative cover in this portion of the reclamation is visually less than other arts of Pit 1, cover is still <br /> good. A small sediment trap has been established at the base of this slope and is effectively dropping <br /> sediment out prior to surface flows reaching PD3. PD3 also flattens out in the bottom of the reclaimed <br /> pit, allowing additional sediment deposition. Sediment does not appear to reach PD3 ditch adjacent to <br /> Jackson County Road No. 12E. (see attached photos) Observation of this area without snow cover finds <br /> that rills are minimal, have limited extent, and do not require mitigation(Rule 4.14.6). <br /> 720 Pit vegetation was visually dominated by sagebrush. 720 pit vegetation looked good, no signs of <br /> rills of erosional features. Repairs to slope north of Pond A are holding well. <br /> Support Facilities: The warehouse/office at the facilities area is approved to remain as permanent <br /> structures in support of the post-mining land use. The facilities yard area remains graveled, and the land <br /> owner has requested that light poles, metal tanks, and other equipment remain on site.
