III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the Carbon Junction Coal Mine was conducted by DRMS staff from the <br /> Durango Office, 701 Camino del Rio, Room 315, Durango, CO 81301, phone (970) 247-5469. <br /> Mine identification sign was posted at the entrance to the permit area. Mine entrance gate was <br /> locked. The site appeared dormant, no mining or reclamation activities were occurring. <br /> Vegetative cover appeared well established for reclaimed areas. <br /> During the August 13-14, 2007 inspection, the Division observed a set of dual culverts located in the <br /> East Collection Channel (immediately north of TS-7) which had become sufficiently obstructed with <br /> sediment and debris to resbIt in an overflow of the East Collection Channel and subsequent escape of <br /> affected area drainage from the sediment containment system. On September 4, 2007, the Division <br /> issued Notice of Violation CV-2007-005 for failure to minimize disturbances to the prevailing <br /> hydrologic balance at the mine site and in associated off-site areas, and failure to maintain one set of <br /> dual culverts in the East Collection Channel. The abatement deadlines were extended on September <br /> 17, 2007, and again on October 10, 2007, in response to requests from the Operator's representative. <br /> On October 10, 2007, the Operator's representative requested that the violation be vacated. The <br /> request for vacation was denied on October 12, 2007. On October 12, 2007, the Division modified <br /> CV-2007-005 to include failure to maintain the East Collection Channel, and failure to retain sediment <br /> within disturbed areas. On November 1, 2007, in response to a request from the Operator's <br /> representative, the abatement deadlines were extended. The Operator's representative has <br /> requested that the issue be considered by the Colorado Mined Land Reclamation Board. Therefore, <br /> the Division has scheduled the issue for the Board's consideration during the December 12-13, 2007 <br /> Board meeting. <br /> No significant change had occurred at the set of dual culverts in the East Collection Ditch, referenced <br /> under Notice of Violation CV-2007-005. <br />
