III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a complete inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division). A final Phase III bond release application is
pending for the majority of the reclaimed area at this site. Ground conditions were dry and
the weather was cool and breezy. Ron Thompson of Peak Project Management represented
the operator during the inspection of the public records.

The public copy of the mine records is kept at the office of Peak Project Management (PPM).

Soil Methane Area
Some of the area
east of the mine site
that has been affected by methane in the soil profile has been recently hydro-seeded due to
a pipeline disturbance. Whether this affected area shows new vegetation growth will not be
known till early next spring.
Overall, this reclaimed site appeared in excellent condition for the fall season.
