111. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the Bear <br /> Coal Company during the field inspection. <br /> Facilities <br /> The operator demolished the mine office and placed all of the debris into a pile. The debris will be burned and <br /> buried on site. The concrete office pad has not been broken up yet. A sack of seed was seen on the ground near <br /> the pile of office debris.No seed tag was on the sack. The operator should not use this seed for reclamation until <br /> a revegetation plan is proposed to the Division for the flat facilities area. <br /> The front gate was latched but not locked. The"no trespassing"sign was on the front gate <br /> Reclamation <br /> The reclaimed fan and portal road and the reclaimed fan area were well vegetated and appeared to be stable. The <br /> west side reclaimed portal area continues to show some instability,however.Also,the odor of smoldering coal <br /> was evident at the west side reclaimed portal area and on the flat facilities area near the hillside spring. <br /> Now that the vegetation on the hillside is beginning to die out for the winter, several pieces of rebar were <br /> observed. Two pieces of rebar were seen on the east side reclaimed fan area and one piece was seen on the west <br /> side reclaimed portal area.Also,three short pieces of rebar were seen at the edge of a large rock on the west side <br /> reclaimed portal area.As the vegetation continues to die out,more rebar may be found.The rebar needs to be <br /> completely removed from the site. <br /> Roads <br /> The paved road was in good condition. The bridge was passable. <br /> Hydrology <br /> There was a small volume of standing water in the sediment pond. The gated primary pipe valve was closed. <br /> The pond embankment was well vegetated,as were the pond inslopes. The hillside spring water treatment pond <br /> was discharging at about 10 to 15 gpm,with the orange color that has been found in the past to be in compliance <br /> with water quality standards. <br /> The collection ditch leading into the sediment pond had sufficient capacity. The culvert at the front gate was <br /> clear. There were no problems with the two alluvial wells.The riverside protection berm had sufficient capacity. <br /> The hillside spring water temperature was 99 degrees Fahrenheit as measured at a location about 10 feet below <br /> the hill origination point. <br /> c:/word/bear3/insp 1107 <br />
