III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator. <br /> Unit Train Loadout <br /> All three gates were open with mine ID signs up on each gate.Empty coal railroad cars were on site.The <br /> sediment pond was dry and the diversion ditches and culvert above the pond were in proper order. The upland <br /> diversion system of ditches and culverts in the center of the loadout site was functioning properly with upland <br /> water passing through the system. The west side collection ditch and half culvert were in working order as well. <br /> Surface disturbance markers were up.The operator continues to slowly ship out the concrete gravel stockpile. <br /> Highway Coal Stockpile <br /> This area had been covered in soil and revegetated after the coal was removed in order to keep down the dust. <br /> The entrance road was passable and dry. The mine ID sign was up at the entrance. The cut slopes were stable. <br /> The sediment pond had only a little standing water in it.The other sediment control structure is the straw bales <br /> around the inlet to the west culvert,which were in place. There was a string of empty coal rail cars on site. <br /> East Mine <br /> The entrance gate was locked and the mine ID sign was up on the gate.The paved haul road and the dirt access <br /> road were in good condition. The operator has constructed upland diversion ditches above the excavated north <br /> end of the West Ridge Waste Pile.Material from the run-of-mine stockpile will be placed here. There were no <br /> stability problems with the cut and fill slopes of the benches. Pond 4 was dry and the gated valve was closed. <br /> West Mine <br /> The backfilled and graded west mine and west mine fan areas had good vegetative cover.The slopes were stable <br /> with no evidence of movement. The two sediment ponds were dry.Both pond embankments were stable. <br /> Surface disturbance markers and mine ID signs were present. <br /> Run-of-Mine(ROM)Stockpile <br /> The cable was down across the entrance road to this site. The graveled haul road was in very good condition. <br /> The top of the ROM stockpile had no standing water. The topsoil stockpile had a good vegetative cover, <br /> although the topsoil sign was down.The sediment pond had a little standing water in it and the primary pipe <br /> gate was in the closed position. The pond embankment was well vegetated and stable. The mine ID sign was up <br /> at the entrance and surface disturbance markers were up around the disturbed area. <br /> Well Field <br /> The mine ID sign was up at the entrance. The road to the site was passable.The topsoil stockpile was well <br /> vegetated and the sign was up. Surface disturbance markers were up around the disturbed area.There were no <br /> problems with the pump house. <br /> c:/word/bowie I/insp 1107 <br />
