III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site is currently finishing the final <br />stages of reclamation of disturbed areas. An industrial land use bond release is currently <br />under review by the Division. Ron Thompson of Peak Project Management represented the <br />operator during the inspection. Ground conditions were dry and the weather was mild. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. <br />Roads <br />One issue that was identified during last month's bond release inspection was culvert <br />maintenance. The second culvert up from the Lorencito haul road intersection required <br />maintenance to remove sediment accumulation prior to bond release. During this inspection, <br />the operator was actively removing sediment at the culvert inlet. This culvert work will require <br />follow-up inspection prior to any bond release decision by the Division. <br />Included in the approve reclamation cost estimate are costs associated with hydro-seeding of <br />the outslope of the Jeff Canyon haul road. The operator indicated that this work had not <br />been completed. While hydro-seeding is not required, seeding of the outslope is required. <br />Unless information is submitted to the Division indicating that seeding of this area has been <br />previously completed, this task must be done prior to any bond release decision. <br />Hydrologic Balance <br />The operator is currently communicating with the landowner regarding the retention of Pond <br />10 as a permanent impoundment for sediment control of the former loadout area that is <br />subject to the pending industrial land use application. <br />Other ponds around the site held modest amounts of water. The exception was pond 8 that <br />was found dry. The operator may move the sediment marker further back toward the pond <br />inlet to better judge accumulating sediment levels. Pond 6 weir box requires cleanout due to <br />upslope sediment sloughing into the box. <br />The east inlet ditch to pond 6 also requires some cleanout and reshaping to keep flows <br />entering the pond at the inlet area to avoid short-circuiting of potential inflows. <br />3 <br />
