("Applicant°) in accordance with Section §37-90-137(11), C.R.S. The required fee of $257.00 <br />for the renewal of this substitute supply plan has been submitted (receipt no. 3620765). The <br />original supply plan was approved on May 1, 2006. <br />Plan Operation <br />This plan seeks to replace depletions resulting from mining at the Lupton Lakes Resource <br />Pit ("Lupton Lakes"). The depletions that result from the mining operation are evaporation, water <br />lost in mined product, concrete batching and dust suppression. The Applicant plans to begin <br />dewatering at the site in November of 2007 to allow dry mining. Depletions will also result from <br />the dewatering operation. <br />The request specifies that wells 19490S, 7280R, 20317R, 1408R, 2819F, 1657RR, <br />2820F, 20583R, 12800R and 19944RF will be used to provide process water to the mining <br />operation. All of the wells are located within the gravel permit boundary in sections 18 and 19, <br />Township 1 North, Range 66 West, 6th P.M. The Applicant has submitted well permit applications <br />to repermit the wells to the requested use. <br />The proposed replacement source is fully consumable water leased from the City of <br />Aurora ("Aurora"). If the mine is dewatered and dry mined, water discharged from the pit during <br />dewatering operations that is in excess of the lagged impacts of the dewatering operation itself <br />will be used as a replacement source in this plan. <br />The final reclamation of the pit includes backfilling of all exposed groundwater within the <br />permit boundary. The Applicant has obtained a bond in the amount of $3,618,200 for backfilling of <br />the pit, as part of their permitting process through the Division of Reclamation Mining and Safety. <br />
