hydrologic changes that adversely affect the approved postmining land use in the permit area. <br />V. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve Eastside Coal <br />Company's request for Phase III (Final) Bond Release. Upon final approval of this proposed <br />decision, Eastside Coal Company will be released from liability for reclamation work at the <br />Eastside Mine in the bond release area and from liability associated with surface areas overlying <br />the underground workings of the Eastside Mine. Upon final approval of this Proposed Decision, <br />the Division will terminate its regulatory authority and jurisdiction over Eastside Coal Company <br />Inc and the Eastside Mine. <br />The original performance bond for the Eastside Mine was $74,280.00. The Division previously <br />released $44,568.00 of reclamation liability in conjunction with the approval of bond release <br />request SL-1, leaving a reclamation liability amount of $29,712.00. The Division subsequently <br />released $18,570.00 of reclamation liability in conjunction with the approval of bond release <br />request SL-2. The permittee chose at that time to leave on file with the Division its reclamation <br />bond in the amount of $29,712.00. The Division determined at the time bond release request SL- <br />2 was approved that the remaining reclamation liability amount at that time was $11,142. <br />Subsequent revisions, and a 2007 Mid-Term Review, modified slightly the $11,142 amount. The <br />Division is now proposing to release the entire $29,712.00 of remaining performance bond. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Glenwood <br />Springs Post Independent as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within thirty days of the first publication in the Glenwood Springs Post <br />Independent.
