FOUR CORNERS MATERIALS <br />A division of Oldtastle SW Group, Inc. <br />21 November 2007 <br />Mr. David Berry <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Ewing Mesa Pit No. l (Permit No. M-1992-116) <br />Carbon Junction Mine (Permit No. C-1992-080) <br />Dear Mr. Berry, <br />~~ ~~ <br />~~'i~E! 2 ~~ 2007 <br />Division of ~ <br />Mirtin~ ar'i~l ~afety;~n, <br />This company, Oldcastle SW Group, Inc. dba Four Corners Materials ("FCM") is the Operator <br />of Ewing Mesa Pit No. 1(Gravel Pit), located in La Plata County, Colorado. This sand and <br />gravel pit was reclaimed in 2005, and we are currently awaiting successful establishment of <br />vegetative cover before we request release of the Financial Warranty from the Division. <br />Our Gravel Pit abuts the permit area for the Carbon Junction Mine ("Coal Mine"), which is also <br />in reclamation. The existing boundary between the two permitted operations was established by <br />Amendments made to both permits in 2003. Surface lands affected by the Gravel Pit and the <br />Coal Mine are all owned by Oakridge Energy, Inc. ("Oakridge"), the Operator of the Coal Mine. <br />FCM is are aware that recent questions have arisen as to the origin of and responsibility for a set <br />of two corrugated metal pipes ("Culverts") that exist within the East Collection Channel <br />("Channel") of the Coal Mine. On O1-Oct-2007, Marcia Talvitie, FCM's Resource / <br />Environmental Mangaer, received an Email from Michael Savage, a consultant acting on behalf <br />of Oakridge and the Coal Mine. The complete body of his message is as follows: <br />I am trying to figure out the history of a couple of culverts on Ewing Mesa between the <br />coal mine and the former gravel pit area. There are two 18-24"culverts under an <br />asphalt access road that went north of the topsoil stockpile up to the west side of the <br />gravel extraction area. Do you know the history of these? Did Durango Construction or <br />Oldcastle install them to facilitate access to that area of the pit? At this point 1 am <br />looking to remove them, but 1 they do not show up in any of my permit documents for the <br />coal mine, and before 1 can remove them CDRMS wants to know their history. Any help <br />you can lend would be appreciated. Attached is a JPEG of that area (sorry for the poor <br />resolution, it was an original blueprint). <br />P.O.
