(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1982-015 <br />INSPECTION DATE 11/02/07 <br />OBSBRVATION3 <br />INSPECTOR'S INITIALS ESC <br />This was surety reduction request (SR-O1) inspection of the St. Vrain Lakes Site conducted by <br />Erica Crosby of the Colorado Division of Reclamation, Mining and Safety. Brad Davis of Carma <br />Bayshore LLC was present during the inspection. The site is located less than one mile north <br />of Firestone in Weld County, Colorado. The site is immediately north of the St. Vrain River <br />and immediately east of Interstate 25. <br />The surety reduction request was received by the Division on October 16, 2007. The approved <br />postmining land use is developed water resources. The site has been lined with a bentonite <br />slurry wall to prevent the migration of ground water into the pit. Carma Bayshore provided <br />the Division with a letter from the Office of the State Engineer documenting that the slurry <br />wall has passed the design standard for the States lining criteria referenced in the August <br />1999 State Engineer Guidelines for Lining Criteria for Gravel Pits. <br />In addition to the completion of the slurry wall, the operator has also backfilled and graded <br />the site, replaced topsoil, installed the required rock armored spillways, armored adjacent <br />to the St. Vrain River and installed a perimeter drain. The remaining task includes <br />retaining a portion of reclamation bond for the perimeter drain and revegetation of the site. <br />The operator estimates $115,545.00 shall be held by the State for future reclamation <br />liabilities. Based on the site inspection and review of the file, the Division will approve <br />the acreage reduction request. Notice of approval will be submitted under separate cover. <br />The Division made note of the following items during the inspection, some of which require <br />action by the operator; <br />o Carma Bayshore stated that QaQc specifications will be submitted to the Division prior <br />to construction (7/31/06 letter). During the inspection, Carma Bayshore provided the <br />Division with "as-built" drawings of the slurry wall and the letter from the State <br />Engineer documenting that the slurry wall has passed the design standard for the States <br />lining criteria referenced in the August 1999 State Engineer Guidelines for Lining <br />Criteria for Gravel Pits. <br />o Carma Bayshore committed to submitting an "as-built" certification prepared and sealed <br />by a professional engineer within 60-days of completion of the embankment stabilization <br />indicating that the work has been performed with the approved designs. The operator <br />provided this certification to the Division on November 20, 2007. <br />o During construction of the slurry wall, a pipeline was damaged that resulted in the <br />release of 46,200 gallons of gasoline. The incident was reported to the EPA and the <br />CDPHE (Colorado Spill Incident No. 2006-1029). Emergency response activities conducted <br />by Rocky Mountain Pipeline (RMP). RMP excavated and disposed of 468 cubic yards of <br />petroleum-impacted soils and disposed of the material in approved landfills. <br />Approximately 1,200 gallons of petroleum-impacted groundwater was pumped from the <br />excavation and treated on site in frac tanks for disposal at the Arvada Treatment <br />Center. A groundwater monitoring plan is currently in place (as required by the CDPHE) <br />to remediate petroleum impacts in groundwater and a final closure if remediation is <br />successful. <br />Rule 3.1.13 of the Construction Materials Rules and Regulations require that the <br />operator notify the DRMS within 24 hours of the time the spill is reported to any other <br />agencies with jurisdiction of the spill and include information regarding the spill. <br />The operator provided the Division with the Integrated Corrective Action Plan and its <br />Addendum on November 20, 2007. Rule 3.1.6 states that disturbances to the prevailing <br />hydrologic balance of the affected land and of the surrounding area and to the quality <br />of water be minimized. The operator will need to incorporate the spill remediation <br />plan and the groundwater monitoring plan into the DRMS permit as a revision to the <br />permit. See page 4 for corrective action due dates. <br />o Carma Bayshore relocated the Kerr-McGee pipeline as a result of the lining of the <br />slurry wall. A Surface Uae Agreement between Kerr-McGee and Carma Bayshore LLC was <br />executed and a copy was provided to the Division on November 20, 2007. <br />
