The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. ~ According to the approved plan, mining excavation would not occur at the December 20, 2007 <br />processing area. However, as shown in the photos, mining excavation has PB or PV: PB <br />occurred at the processing area to result in two ponds; a north pond and a south TOPIC(S): MP <br />RS,_, <br />pond. Therefore, the mining activity did not progress in accordance with permit <br />conditions and the reclamation plan must be revised to reflect the two ponds. <br />CORRECTIVE ACTION: Within 30 days from the signature date of this report, <br />by December 20, 2007, submit a Technical Revision to the permit to describe <br />the mining excavation which has occurred at the 3.64 acres processing area <br />and describing how the Operator will reclaim the affected lands. The Technical <br />Revision shall contain a revised reclamation plan and map, submitted in <br />accordance with the applicable requirements of Rules 6.2(2), 6.3.4(1)(d), and <br />6.3.5(3). <br />The permit documents do not verify that the Operator has procured a well <br />permit for the evaporative loss of the exposed groundwater for the two ponds <br />created by this operation. Pursuant to Rules 3.1.6(1)(b), 6.3.3(i) and (j), the <br />Operator must minimize disturbances to the prevailing hydrologic balance by <br />complying with applicable Colorado water laws and regulations governing injury <br />to existing water rights. <br />CORRECTIVE ACTION: Within 30 days of the signature date of this report, by <br />December 20, 2007, demonstrate how the operation is compliant with the <br />requirements of Rule 3.1.6(1)(b), 6.3.3(i) and Q), for the two ponds created by this <br />operation. <br />CERTIFICATE OF SERVICE <br />I, Wallace H.
