DEPARTMENT OF THE ARMY <br /> CORPS OF ENGINEERS.OMAHA DISTRICT <br /> TRI-LIKES PROJECT OFFICE.9307 STATE HWY 121 \ <br /> LrrrLETON.COLORADO 80123-6901 50' I <br /> REPLY TO May 10, 1995 <br /> ' - ATTEWION OF <br /> Ms. Peggy Anderson <br /> ' Anderson & Company <br /> 420 Sunset Street <br /> Longmont, Colorado 80501-4768 <br /> RE: Nationwide Permit No. 199580280 <br /> ' Dear Ms. Anderson: <br /> We have reviewed your request for Department of the Army authorization to <br /> impact approximately 0.95 ac of ponds and wetlands for gravel mining on behalf of <br /> Connell Resources, Inc. for the 9512-Wellington Downs Pit. The pit is located in <br /> Section 3, Township 6 North, Range 68 West, Larimer County, Colorado. <br /> Based on the information you provided, this office has determined that your work <br /> within Colorado can be authorized by the Department of the Army Nationwide Permit <br /> found at 33 CFR Part 330 Appendix A, (13)(26). Enclosed is a fact sheet which fully <br /> describes this Nationwide Permit and lists the General and Section 404 only conditions <br /> ' which must be adhered to for this authorization to remain valid. <br /> Although an Individual Department of the Army permit will not be required for <br /> the project, this does not eliminate the requirement that you obtain any other applicable <br /> federal, state or local permits as required. Please note that deviations from the original <br /> plans and specifications of your project could require additional authorization from this <br /> ' office. <br /> You are advised that this verification of the nationwide permit authorization is <br /> ' valid until November 22, 1996. <br /> Also, the wetland delineation dated April 4, 1995 is considered accurate and <br /> acceptable by this office. The wetlands are considered to be waters of the United States <br /> pursuant to Section 404 of the Clean Water Act. <br /> ' This wetlands jurisdictional delineation is valid for a period of five years from the <br /> date of this letter unless new information warrants revision of the delineation before the <br /> expiration date. <br /> If you have any questions concerning this determination, please feel free to contact <br /> Mr. Terry McKee of my staff at (303) 979-4120 and reference Nationwide Permit action <br />
