down gradient of the proposed bulkhead, between the bulkhead and the canyon wall.
Since the mine will not flood until the bulkhead is installed at the time of mine closure,
the collection of baseline data from the point of compliance well can proceed
concurrently with mining.
d) Cost estimates for the design, construction and monitoring of the bulk head appear to be
insufficient. Division experience indicates costs in the magnitude of 40 to 50 times the
$7,000.00 figure given. Enclosed is the Division's estimate for the cost to construct one
required and two contingency bulkheads. Please clarify.
21) Please identify potential areas for undergroe unlesstthe~e areas are ide tified otential contact with
groundwater can not be adequately addre
22) It is noted that topsoil will be used for safety berms at both the Whirlwind and Packrat. Based on
the fact that there is limited topsoil, the Division will require that waste rock is used for such
berms to protect topsoil loss from potential erosion or mixing with non-topsoil materials.
23) Please clarify stormwater control measures for the fueling station area. There should be a zero
run-off design to contain spillage in the area. Also please clarify that the area will be monitored
on a regular basis for fuel spillage and clean-up procedures.
24) Please provide construction details for all concrete structures. Steel reinforcements, thickness etc.
must be accounted for in reclamation tasks.
25) Please clarify measures that will be instituted to prevent collector ditch PD-1 from compromising
the topsoil and fill areas that it iransects.
26) Does stormwater pond design take into a rd tall tames fortthe designed 100 year evlent e pond be
monitored to provide a mimmum free boa
This review is preliminary as noted. Responses to the Division's questions may raise other issues that
need additional information to resolve. Energy Fuels needs to submit responses to the Division's review
no later than December 14, 2007 in order to ensure adequate time for staff review prior to the decision
date.
The Decision Date is currently December 24th, 2007. Per Rule 2.0 the following schedule is tentatively
set:
On or before December 24, 2007 Division will issue "Letter of Rational" (Rule 1.4.9(c)).
December 27, 2007 Pre- Hearing Conference (PHC), Grand Junction
3 working days after Letter of Rational (Rule 2.7.1(5))
December 31, 2007 All Motions filed with the Board
2 working days after PHC (Rule 2.6 (1))
January 4, 2008 Written responses to all motions filed with Board (Rule 2.6 (1))
3 working days prior to Board Hearing (Rule 2.6 (1))
