Box 449 <br />Florence, CO 81226 <br />RE: 4th Quarter 2002 and Is`, 2"a Quarter 2003 Refuse Pile Inspection Report <br />Review, Raton Creek Mine, Permit No. C-82-055 <br />Mr. Patterson: <br />The Division of Minerals and Geology has completed review of the 4a' quarter 2002 and <br />the ls` and 2"a quarter 2003 refuse pile inspection reports for the Raton Creek mine, #C- <br />82-055. <br />Each report demonstrates compliance with Rule 4.10.2(2) for coal mine waste banks. In <br />particulaz, the engineer is noting the presence or absence of seepage that could affect the <br />pile stability, in accordance with Rule 4.10.2(2). Observations are consistent with field <br />observations noted during Division inspections over the three quarters covered by the <br />reports. One question resulted from our review. <br />The second quarter report refers to soil testing results and indicates they were attached. <br />The Division did not receive any soil testing results with the refuse pile reports. Please <br />submit the soil testing results for Division review. Also, if the seeding has been <br />completed, has fertilizer been applied as recommended by the report? If so, please <br />document the application of this fertilizer. <br />We have no further questions or comments at this time.
