help to ensure that future permit actions requiring ownership information is complete and
correct. I must reiterate, however, that this office relies almost entirely on current
representations of landowners' identities that are contained in~each permit application.
Your letter simply asks that your client be shown as an owner in the Zellitti Pit permit
file. Please note that land ownership is separate and distinct from the position of being a
permittee. As such, we cannot add your client's name as one of the entities to whom this
permit is issued. If that is desired, this office will require documentation showing that the
change is agreeable to the current permittee, Anthony Zellitti. Aside from that, it appears
to this office that if there are past and/or future differences to be resolved, they exist apart
from the name on the permit, and might be better addressed as a civil matter.
Thank you for your letter. I have forwarded your request for CD copies of this file to our
Denver office. If you need additional information please feel free to contact me at the
Division's Durango field office: 701 Camino del Rio, Room 315, Durango, CO 81301.
Sincerely,
fit?
Bob Oswald
Environmental Protection Specialist
Ec: Tony Waldron, DRMS
(c:\07-11 docs/zellitti prop to resp/rco)
