Tne Mined Land Reclamatton Act and Permit No. M-86-155 require you to suomit
$50.00 in annual fees and an annual reDOrt oy August 27 of each yea We have not
received fire annual fees and report. Therefore, we have found tha there is reason
to believe a violatton exists to Permtt No. M-86-165 and the Law a d have
scheduled tnis matter before the Mined Land Reclamatton Board.
A Formal Puolic Hearing wtll be held during the Septemoer 20-21, 1 9 Board meeting
for constderatton of posstole violation. Tne nearing will be held in Room 220 of
1313 Snerman Street, Denver, Colorado, oeginning at 9:00 a.m. or as soon thereafter
as the matter can oe considered and you wiil have the opportum ty be represented
and heard. It will oe reiterated tnat Uiere is reason to believe at you are in
violation of the permit and the Law, specifically the following pr ision:
Failure to provide annual fees and annual report required b~ 34-32-110(4),
C.R.S.
If the Board finds a violation at this nearing, it may issue a teas and desist
order, assess a civil penalty in the amount of $50.00 to $200.00 f r each day of
violatton or order Uie permit suspended, modified, or rev ox ea. In addition, it
mayset the matter for constderatton of forfeiture of the $2,500.00 financial
warranty at a suosequent nearing.
