Rule 4.10.1(1)(b) To prevent combustion. <br />Materials were being compacted to prevent combustion. <br />Rule 4.10.2(1) A[l coal mine waste banks shall be inspected, on behalf of the person conducting <br />surface coal mining operations by a qualified registered engineer, or other qualified <br />professional specialist under the direction of the professional engineer, experienced in <br />construction ofsimilar earth and waste structures, approved by the Division. <br />See Rule 4.09.1(11)(a) above. <br />Rule 4.10.2(Z)(a) Inspection shall occur at least quarterly, beginning within 7 days after the <br />preparation of the disposal area begins. The Division may require more frequent inspection <br />based upon an evaluation of the potential danger to the health or safety of the public and the <br />potential harm to land, air and water resources. Inspections may terminate when the coal mine <br />waste bank has been graded, covered in accordance with 4.10.4(4), topsoil has been distributed <br />on the bank in accordance with 4.06.4, and revegetated, or at such a later time as the Division <br />may require. <br />This was a report of a quarterly inspection. <br />Rule 4.10.2(2)(b) Inspections shall include such observations and tests as may be necessary to <br />evaluate the potential hazard to human life and property, to ensure that all organic material and <br />topsoil have been removed and that proper construction and maintenance are occurring in <br />accordance with the plan submitted under 2.05.3(8) and approved by the Division. <br />The report is in compliance with this rule. Compaction [see Rule 4.10.4(3) of the rules] testing <br />and findings are discussed. <br />Rule 4.10.2(2)(c) The engineer or other approved inspector shall consider steepness of slopes, <br />seepage, and other visible factors which could indicate potential failure, and the results of failure <br />with respect to the threat to human life and property. <br />The report complies with this rule. <br />Rule 4.10.2(2)(4) See the rules for the text of this rule. This rule is a performance requirement. <br />Rule 4.10.2(3) If any inspection discloses that a potential hazard exists, the Division shall be <br />informed promptly of the finding and of the emergency procedures formulated for public protection <br />and remedial action. Ifadeguate procedures cannot be formulated or implemented, the Division <br />shall be notified immediately. The Division shall then notify the appropriate emergency agencies <br />that other emergency procedures are required to protect the public from the coal mine waste area. <br />No potential hazard was identified. <br />
