NMIeVpougc/COrIex55/112Ann Rep~99 • <br />/1 <br />According to C.R.S. 34-32-1 16(.3), and C.R.S. 34- 32.5- 116(3)(x), on the antuvcrsary date of the permit each year', <br />[he operator shall submit a repott and a map showing the extent occurrent disturbances w affected land, <br />reclamation accomplished to date and durine [he preceding year, new disnubances tttat are anticipated W occur <br />durine the upcoming year, and reclamation that will be performed during the upcoming year. Please attach such <br />a repott and map to enclosed annual report form. (An adequately labeled ntap [hat clearly delineates and includes <br />the above elements may suffice for a written report.) <br />If your operation is subject ro the provisions of Temporary Cessation as defined in the Act and Rules, you must <br />provide with the Annual Report the following information as required by :: CCR 4117- 1.407-4, and Rules <br />1.13.7(1)(x): <br />(i) the condition of [he operation at the time of cessation; <br />( ii) what specific measures have been and will be implemented [o comply with reclatnatiun, <br />performance standards and Environmental Protection Plan reyuirements, if they arc part of your <br />approved application; and <br />( iii) plans fur resumption of mining operations. <br />Please provide the additional following information with your Annual Refort. as applicahle: <br />(a) Per the reyuirements of 2 CCR 407-1, 407-4. and Rules l.]Si 1),provide an updated statement <br />regarding the sullicicncy of the value of the Financial Warranty, specifically: <br />(i) Per the requirements of Z CCR 4117-I, 407-4, and Rules 1.15(1)(x), provide an updatt:d statement regarding <br />the sufficiency of the value of the financial warranty. Specifically, irrevocable letters of credit, Deeds of Trust, <br />and security agreements, salt-insurance, sah~age credit, and first priority li?its on project related fixtures. <br />( ii) Per the reyuirements of 2 CCR 407-1, 407-4, and Rules 1.15(1)(b), permits secured with a <br />Deed of Ttvst or a Security Agreement, the operator shall subnut an updatt:. by a yualiticd <br />independent appraiser, indicating any changes in property value, and a statement summarizing <br />any circumstances which may affect the adequacy of the Deed of Tnts[. ur Security Agreement, <br />and Ure value of the progeny suhject to either of these utstmmcnts. <br />The report shall also provide proof that there era nu patt-due progeny toes. <br />( iii) Per the reyuirements of 2 CCR 407-I, 407-4, and Rules =4.7(3), permits secured with an <br />Itrecucable Leiter of Credit, the operator shall have the bank provide documentation in the funs <br />of a balu;:ce. sheet, cenaied by a Cenit7cd Public Arcuuruuu. den:o:~straung that tl;e Letter of <br />Credit dues nut exceed ten percent (10`70) of the bank's capital surplus accounts. <br />( vi) Pcr the reyuirements of 2 CCR 407-1, 407-4, and Rules 4.9 3(c), permits secured by a First <br />Priority Lien nn any fixtures and Equipment, the operator .:hall provide a rt:port in sufficient <br />detain to fully describe the condition, value, and lucauon of all pledged fixtures and equipment. <br />(h) Per the reyuirements uc Z CCR 407- I, 4t)7-4, and rules 1.15(I)(c), all m~mitoring information <br />required as pan of the approved permit application, to include the I.nvironmental Protection Pl;ut. <br />(Phase nose that if you arc not a Designated Ivlitung Operation, you will nut have an Environmental <br />Pnxcction Plan as part of your appnn•ed permit.) <br />
