Cattany <br />date: January 10, 2003 Acting Division Director <br />Rule 4.05.13(4)(b): Ground water and surface water data collection shall be based upon a water <br />year (October 1 through September 30), unless otherwise approved by the Division. <br />The report is in compliance with this rule. The Division has approved submittal on a calendar <br />yeaz basis [Permit Application Package (PAP) page 4-122]. <br />Rule 4.05.13(4)(c): A hydrologic report shall be submitted to the Division annually with the date <br />ofsubmittal determined in consultation with the permittee. The annual hydrologic report shall <br />contain at a minimum: <br />The report is in compliance with this rule. The date ofsubmittal of March 30 is stated in the PAP <br />(page 4-122). The report was submitted under a MINREC, INC. letter of January 6, 2003 and <br />received in the Division of Minerals and Geology (Division) on January 8, 2003. <br />Rule 4.05.14(4)(c)(i): Water quantity data obtained from each monitoring site during the water <br />year; <br />The report is in compliance with this rule. Water quantity data was submitted by calendar yeaz in- <br />lieu-oftyater yeaz. <br />Groundwater quantity data of the monitoring program is limited to quarterly measurements of water <br />level in Wells D-lA and D-2A (PAP page 3-61). These data aze reported in compliance with the <br />permit. Although monitoring of water levels in Mine 3 was discontinued (piezometers PZ-2 and PZ- <br />3) byprevious revisions, mine water levels aze included in the report (Appendix III). Measurements <br />were taken on 04/25/02 and 07!08!02, through an opening into the mine. <br />Discharges of mine water are included in surface water monitoring. Surface water quantity <br />monitoring requirements include those of the Colorado Permit Discharge System (CDPS) permit <br />(PAP page 3-86). The combined total of flows from Mine 1 and Mine 3 aze reported, starting in <br />August of 1995, in compliance with a change to the CDPS permit. The report states (page 5) that <br />there were no discharges from sedimentation ponds [at CDPS outfalls 002 (Sediment Pond P-9) and <br />005 (Refuse Pile Sediment Pond)].
