Walker <br />subject: Review for Compliance <br />date: Apri128, 2004 <br />Rule 4.05.9(17) All impoundments shall be examined at least quarterly by a qualified person <br />designated by the operatorz for appearance ofstructural weakness and other hazardous conditions] <br />The reports shall be retained at or near the mine site°, and a copy of the report shall be submitted to <br />the Division on a quarterly basis, or other approved submittal frequency5. <br />With the exception of inspecting six impoundments (Wash Bay Pond, Taylor Pump Holing Pond, <br />Aeration Pond, North Overflow Pond, South Overflow Pond, and the Sediment Sump Pond) <br />during the 2"d Quarter, the report demonstrates compliance with this rule. The reported dates of <br />inspections are presented in the following table. zA qualified person (Kurtis Blunt) made the <br />inspections and the report is certified by a registered professional engineer (Jaye Pickart). 3The <br />ponds were inspected for appearances ofstructural weakness, erosion and other hazazdous <br />conditions Reports are maintained at the mine site4 as validated by Division of Minerals and <br />Geology (Division) quarterly coal complete inspections at the site. A copy of the report(s) is <br />submitted to the Division on an annual basis (by April 1 following) in the Annual Hydrology <br />Report (AHR) (Permit page 4.05-115). Colowyo was permitted to reduce the frequency of <br />inspection for stock ponds/small depressions on June 5, 2002.
