Board Order dated 8/24/95 directs the Division to reconsider <br />requirement for ground water investigation and characterization <br />study. The Board Order further directs the Division to confer with <br />Homestake Mining Company (HMC) and devise a method of complying with <br />appropriate water law. <br />2. The Division of Minerals and Geology (DMG) met with the Water <br />Quality Control Division (WQCD) on December 9, 1994; discussions <br />during this meeting included approaches to coordinate the two <br />Division's efforts to resolve water quality issues at the Bulldog <br />Mine. It was agreed that the type of ground water information that <br />would be required for DMG to establish numeric protection levels and <br />points of compliance for ground water, would be essentially the same <br />information that WQCD would need to evaluate the potential for <br />surface water quality impacts that may be caused by the Bulldog <br />Mine. WQCD and DMG agreed that DMG would implement the ground water <br />regulations of Rule 3.1.7 (Mineral Rules and Regulations of the <br />Mined Land Reclamation Board) at the Bulldog Mine, and would share <br />information with WQCD so that the potential for surface water <br />impacts could be evaluated by WQCD. HMC was notified of the nature <br />of the discussions between DMG and WQCD in a letter from Dave Holm <br />dated 12/19/94. Since the Mined Land Reclamation Board has directed <br />the DMG to reconsider any requirement to implement a ground water <br />characterization study at the Bulldog Mine, DMG has decided not to <br />pursue any characterization of the potential for ground water <br />impacts that may have been caused by underground mining activities <br />or by the underground disposal of mill tailing. WQCD has been <br />notified of DMG's current position, and, as such, WQCD will become <br />the lead agency in the assessment of ground water impacts related to <br />flooding of the underground workings in terms of the potential for <br />mine pool water to discharge to surface water.
