COLOWYO COAL COMPANY LP <br />2002 ANNUAL RECLAMATION REPORT <br />COMMENTS AND RESPONSES <br />CDMG 9/23/2003 TECHNICAL ADEQUACY LETTER <br />Comment 1: In your next report (for 2003:, please change 2001 to read 2002 in the <br />notation for area EP037 on Exhibit 7 map. In the text, Colowyo Coal <br />Company, L.P. (Colowyo: states that this area was seeded in 2002 and <br />deleted from the 2001 listing. <br />Response: Colowyo has made the suggested changes on the 2002 Annual Report <br />Map. <br />Reference: See the revised 2002 Annual Report map enclosed. <br />Comment 2: Your Permit (page 2.05-57 of the Permit Application Package: requires a <br />random sampling of topsoil. None were report, nor did 1 find where any <br />have been reported as far back as 1994 (ARRs:. This Comment was <br />identified in the Divisiion of Minerals and Geology (Division: review dated <br />October 25, 2002, of your 2001 ARR. The December 6, 2002 response <br />by Colowyo was that it would be adderessed in the South Taylor <br />revision. However, this revision was not forthcoming. P/ease submit a <br />technical revision (a change in the environmental monitoring program, <br />Rule 1.04 (136:] for consideration that deletes this requirement so as to <br />be in effect before your 2003 ARR submission, or, accomplish the <br />monitoring and include your findings in your 2003 ARR. <br />Response: Colowyo will address topsoil sampling in a Technical Revision. We <br />apologize for this oversite and added confusion. <br />Reference: None <br />Comment 3: In your 2003 ARR, please revise the Annual Report Map legend for <br />"offsite fill areas" to read "Excess Spoil Fills". Although not listed in the <br />dictionary section of the Rules, offsite (offsite, off-site:{sic} has a <br />connotation as being outside the permit boundary {see Rules 1.04 (17:, <br />2.04, 6 (1: © 2.06.7 (4: (e:, 4.01.1 (7:, 4.14.1 (2: (b:, etc.]. <br />Response: The 2002 Annual Report Map has been revised as per your request. <br />-.z~~.- <br />
