Additionally, priority rights are <br />established chronologically for livestock tanks (not to be confused with a <br />court approved water right). Trapper appears to have the lowest (oldest) <br />number of this streambed until one reaches the SW 114, Section 9, TSN, R91W. <br />Presently, the Division of Minerals and Geology would not be in the position <br />to intervene since it appears that Trapper is in compliance with the Rules and <br />Regulations governing coal mining. <br />I have enclosed pertinent sections of the Rules and Regulations pursuant to <br />the Colorado Surface Coal Mining Reclamation Act.
