<br />-2- <br />• CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2},(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Hard Rock Paving 8 Redi-tdix to: <br />1. Cease and desist from conducting the following mining operations at the <br />Hard Rock 291 Pit, Permit M-77-195, <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />Submit the 550.00 Annual Fee, Notice of Intent to Continue Mining (Annual <br />Reportl, and Map for 1990 for Permit No. M-77-195 to the Mined Land <br />Reclamation Division by no later than June 1, 1990. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of 550.00, within 30 days of the signature date of this document. <br />This Cease and Desist Order shall remain in effect until all to rtns have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions reauirina certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with iudicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this 30th day of April, 1990. <br />COLORADO MINED LAtlD RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />~~~ ~ <br />rnt~. uHrr~a,'w~ctor <br />Mimed Land Reclamation Division <br />• FRB/bdc <br />7027G <br />
