� <br />Poverty Gulch Project <br />0 <br />CONSENT FOR RIGHT OF ENTRY FOR RECLAMATION ACTIVITIES <br />Hubert And Ingrid Vangessner hereby represents to the State of Colorado, <br />Department of Natural Resources, Division of Mined Land Reclamation, that the <br />undersigned is the land owner of the following real property located in the <br />County of Teller and the State of Colorado: An undivided interest in the <br />Queen Bess Lode, m.s. 7530A. <br />As such, the undersigned hereby grants to the agents, employees, and <br />contractors of the Mined Land Reclamation Division, Department of Natural <br />Resources, State of Colorado, permission to enter upon such lands to restore, <br />reclaim, abate, control or prevent the adverse effects of past mining <br />practices and to do a" things necessary or expedient to protect the public <br />health, safety or general welfare; including post reciama: ion ati- nitorinc and <br />maintenance work as required. Such activities are in the public interest. <br />Consent is given to enter upon the above — described property for the length of <br />time necessary to complete the reclamation activity described on the attached <br />"Project Narrative ", subject to the undersigned's continued ownership and use <br />of the property. Inactive mine openings are inherently dangerous, unstable <br />and subject to rapidly changing conditions. During the construction phase <br />such changing conditions may make it necessary to safeguard the opening(s) <br />using an appropriate alternative abatement method. <br />In giving consent to this entry, no rights are waived which are conferred by <br />virtue of the language contained in Title IV of the Surface Mining Control and <br />Reclamation Act of 1977, 30 U.S.C. 1231, et sea. and /or the Colorado Surface <br />Coal Mining Act of 1979, 1973 C.R.S. 34 -33- -133. <br />j <br />Form B <br />4987G <br />
