CONSENT FOR RIGHT OF ENTRY FOR RECLAMATION ACTIVITIES
Tenderfoot Mining Company hereby represents to the State of Colorado,
Department of Natural Resources, Mined Land Reclamation Division, that the
undersigned is the owner, one of the owners, or represents the owner of the
following real property located in the County of Teller and the State of
Colorado:An undivided interest in the Pactolus #2 Lode m.s. 9878, Lulu Lode
m.s. 8823 am, Bonanza King #2 Lode m.s. 8823 and Hilltop Lode m.s.8691.
As such, the undersigned hereby grants to the agents, employees, and
contractors of the Mined Land Reclamation Division, Department of Natural
Resources, State of Colorado, permission to enter upon such lands to restore,
reclaim, abate, control or prevent the adverse effects of past mining
practices and to do all things necessary or expedient to protect the public
health, safety or general welfare. Such activities are in the public interest.
Consent is given to enter upon the above - described property for the length of
time necessary to complete the reclamation activity described on the attached
"Project Narrative ", subject to the undersigned's continued ownership and use
of the property. Inactive mine openings are inherently dangerous, unstable
and subject to rapidly changing conditions. During the construction phase
such changing conditions may make it necessary to safeguard the opening(s)
using an appropriate alternative abatement method.
In giving consent to this entry, no rights are waived which are conferred by
virtue of the language contained in Title IV of the Surface Mining Control and
Reclamation Act of 1977, 30 U.S.C. 1231, et. seq. and /or the Colorado Surface
Coal Mining Act of 1979, 1973 C.R.S. 34 -33 -133.
