C. Comprehensive General Liability insurance, with minim limits of
$1,000,000 for injury to or death of any person or persons, for property
damage, and for contractual liability coverage insuring the indemnity
provisions of this Agreement. Contractor, at its option, may obtain and
maintain a separate contractual liability policy with minimum limits of
$1,000,000.
D. Comprehensive Automobile Liabrlrty insurance applicable to any owned, non -
owned and hired automobiles, with a combined limit for bodily injury and
property damage of not less than $1,000,000 per occurrence.
7.1 All of the insurance coverage required shall be written by an insurance
company or companies acceptable to Owner and shall be maintained in full force
and effect during the term of this Agreement. All policies, except workers'
compensation insurance policies, whether specifically mentioned above or not, shall
name as additional insured, Pikes Peak Mining Company, its parent, subsidiaries and
affiliated companies, joint venturers, co- owners of leases and claims, contractors,
and any and all of their respective agents, officers, directors and employees ( "the
Owner Group "). All of the insurance, whether specifically set forth above or not,
shall waive s�b:ogation against Owner Group and the above persons. All insurance
provisions shall be placed with insurance companies satisfactory to Owner and shall
be endorsed to provide that, with respect to the work to be performed by Contractor
hereun4er, the coverages afforded shall be primary in relation to any other policies
carried by Owner and the above persons named as additional insureds. All policies
shall further provide that underwriters are obligated to provide Owner at least thirty
(30) days' written notice of cancellation, amendment or alteration. 'r,
7.2 Certificate of Insurance Contractor shall furnish certificates of insurance to
Owner evidencing the coverages set forth in this Article. The certificates shall
provide for thirty (30) days' notice of cancellation, amendment or expiration to
Owner.
8. The duties and obligations of Contractor in Sections 2 through 7 above are
enforceable only against Contractor and not Colorado.
9. Colorado guarantees that the Work will be designed and engineered in accordance
with professional standards generally prevailing in Colorado.
10. All the covenants and agreements of Contractor contained in this Agreement shall
inure to the benefit of the successors and assigns of Pikes Peak Mining Company.
11. This Agreement shall be effective for the period of time necessary for Colorado and
Contractor to effect the Work, but in no event shall the permission for entry extend beyond
twenty-four (24) months after the date of this Agreement, unless Pikes Peak Mining
Company has specifically agreed to an extension in writing.
