7/11/02 <br />C-81-019 <br />AHR <br />RULE 4.05.9(17) <br />Rule 4.05.9(171 <br />Colowyo inspects all impoundments quarterly by a qualified person designated by the operator, <br />for appearance of structural weakness and other hazardous conditions. The reports are <br />retained at the mine site, and copies of the reports are submitted to the Division in Exhibit i of <br />this Annual Report. Colowyo submitted Technical Revision 55 (TR-55) to the Division on <br />December 11, 2002. TR-55 requested approval to waive the requirement for quarterly <br />impoundment inspections of impoundments which are not the primary sediment control <br />structure for a particular area; are constructed in reclaimed areas of the mine to enhance the <br />approved postmining land use; which are completely incised, or which have a storage capacity <br />no greater than two-acre feet and an embankment no greater than five feet in height, while <br />maintaining an annual inspection as required by Rufe 4.05.9(14). At the Division's request, and <br />in accordance with Rule 4.05.9(18)(b), Colowyo is preparing a written safety demonstration by a <br />professional engineer. Colowyo will continue performing 4uarterly inspection of these types <br />(stockponds/small depressions) of impoundments until the Division has approved TR-55. <br />RULE 4.05.13(4)(c) Monitoring Report Requirements (surface and ground water) <br />All analytical results from surface and ground water monitoring have been tabulated and are <br />kept on file at Colowyo Coal Company L.P. Historical data is presented in this AHR. The <br />monitoring timeframe for this annual report is from January 1, 2001 through December 31, <br />2001. A description of the surface and ground water monitoring plan is located in Colowyo's <br />CDMG Permit, Volume 1, Section 4.05.13 on page 4.05-10 of the permit. <br />Surface water monitoring sites comprise one upstream and two downstream sites and are <br />briefly described below: <br />New Upper Good Springs Creek (NUGSC) -upstream site, located south of the mine <br />along Moffat County State Highway 13. <br />Lower Good Spring Creek (LGSC) -downstream site, located below active mining <br />conditions along Moffat County State Highway 13. <br />• Lower Taylor Creek (LTC) -downstream site, located below active mining conditions <br />along Moffat County Road 17. <br />Ground water monitoring sites comprise one up dip and two down dip shallow alluvial wells and <br />are briefly described below: <br />A-6 Well (A-6) -located south of the mine along Moffat County State Highway 13. <br />North Good Springs Well (NGSW) -located along Moffat County State Highway 13. <br />Gossard Well -located within the rail loop facility.
