Elk Mine in significant noncompliance with permit conditions.
Report Outfall
Period Number Parameter
2Q96 004A Total Suspended Solids, mg/I
Total Suspended Solids, mg/1
Reported Permit
R c~cl Conditions
114 (30~ay avg) 35 (30-day avg)
284 (max 7-day avgj 70 (max 7-day avg)
3Q96 004A Total Suspended Solids, mg(1
002A Total Suspended Solids, mg/l
Total Suspended Solids, mg/I
43 (30-day avg) 35 (30-day avg)
60 (30-day avg) 35 (30-day avg)
140 (max 7-day avg) 70 (max 7-day avg)
Because of the apparently previously unforeseeable circumstances surrounding these violations and MCC's
responses to attempt to minimize and measure the environmental impact, the Division ttas been able to exercise
enforcement discretion with respect to these violations. However, as communicated to your environmental staff,
continuing to develop the mine into this known fault zone prior to emplacing facilities and procedures to prevent
future permit effluent limit violations will likely be met with formal enforcement action. Should the Division
pursue formal enforcement action, it will include the imposition of penalties of up to $10,000 per day of
violation. Days of violation may include reported violations up to three years prior.
To provide the Division with a more complete picture of the effluent quality during 1996, for each discharge
point, please submit a document summarizing [he dates of discharge and corresponding analytical data. Please
submit this summary to the Division by •-annarv 10. 1996.
If you have any questions, please contact me at 692-3603.
