III IIIIIIIIIIIIIIII <br />999 <br />Ft~ Fi/c <br /> <br />MOFFAT COUNTY <br />ROAD DEPARTMENT <br />August 15, 1995 <br />Division of Minerals & Geology <br />ATTENTION: Mike Long <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Dear Sir: <br />RECEIVED <br />AUG 1 g 1995 <br />Division of rvunerais s Geology <br />As you are awaze, the Moffat County Commissioners believe that the Mined Land <br />Reclamation fees are confiscatory and discriminatory against county road departments. <br />And, that these prohibitive fees and regulations were not intended by the General Assembly <br />to include county governments. <br />It is our understanding that the Mined Land Reclamation Boazd has asked for a FORMAL <br />opinion from the Attorney General on these issues and that the Attorney General has <br />agreed to review them. <br />Based on these assumptions, the Moffat County Boazd of Commissioners have instructed <br />the Moffat County Road Department to respectively decline making any further payment <br />of all pending Mined Land Reclamation fees until the Attorney General's opinion settles <br />these questions. <br />Respectfully yours, <br />Warren J.
