DEPARTMENT OF THE ARM Y
CORPS OF ENGINEERS, OMAFLA DISTRICT
DENVER REGULATORY OFFICE, 9307 S. WADSWORTH BUOLEVARD
LITTLETON, COLORADO 80128-6901
Mazch 19, 2004
Mr. Don Blake
Land Use Administrator
Lincoln County
P.O. Box 39
Hugo, Colorado 80821
RE: Department of the Army (DA) Application number 199980237
AMENDMENT #1
Deaz Mr. Blake:
Reference is made to your Department of the Army (DA) permit application number
199980237 for the excavation of a maximum of 7,500 cubic yards a yeaz from 3.5 acres of dry
streambed of the Arikazee River in Section 33, Township 6 South, Range 52 West, Lincoln
County, Colorado. The permit is set to expire on July 31, 2004, and you aze requesting the
permit be extended 10 yeazs to July 31, 2014.
Our office conducted a site visit to do a compliance check on March 16, 2004, and found
you in compliance except for Special Condition A that states:
"That native grasses will be planted within the mining boundaries to reduce erosion, promote
the growth of native vegetation, and improve wildlife habitat. Planting wilt be performed
during and prior to the completion of the mining operation in areas that are heavily
disturbed. "
It is appazent that the vehicular activity is of such frequency that to require constant
revegetation would be impracticable and a waste of time, resources, and seed. Therefore, Special
Condition A is amended as follows:
"That native grasses will be planted within the mining boundaries to reduce erosion, promote
the growth of native vegetation, and improve wildlife habitat Planting will be performed prior
to the completion of the mining operation, if praMical, but must be planted at the cessation of
all mining activities."
The Corps of Engineers has reviewed your request and, with the additional modification
of Special Condition A, extends your permit until July 31, 2014. Be sure to attach this letter to
your permit.
