Please refer to the crushing log for days of operation and <br />amounts of material processed. The enclosed map defines where the mining distwbance <br />occurred inside ow permitted area. Since mid November 2005 until present, no other <br />surface distwbances have been performed by Pathfmder Development. All mining related <br />activities by Pathfmder ceased on November 1601, 2005. <br />Public Service Company of Colorado does have anon-exclusive easement through ow <br />property that generally follows the abandon Rio Grande Southern Railroad bed. Within <br />this easement lies a 30+ inch penstock that services the antique Ames Hydroelectric <br />plant. This summer PSCo did perform extensive maintenance to sections of this pipeline, <br />including some 400 feet of pipe replacement, portions of which occurred within the <br />Pathfinder DMG permitted area. Old fiberglass pipe was dug up and replaced with new <br />ductile iron pipe. This replacement did distwb ow haul road during construction. <br />However, PSCo has re-surfaced the haul road and returned at least a portion for <br />Pathfinder's use, the sufficiency of which remains in the condemnation proceedings, <br />discussed below. We monitored the construction project and made every effort to enswe <br />that their surface disturbance would not alter ow storm water management plan. Though <br />this was not a mining activity, nor was it performed by the permit holder Pathfinder <br />Development, we feel it should be noted in this report and the DMG made aware of the <br />occurrence. If more information is required, please contact Public Service Company of <br />Colorado. (Owned and operated by Xcel Energy) <br />Further we wish to add that in December 2005 PSCo filed a Petition in Condemnation, <br />for an exclusive easement for their penstock through the Pathfinder property. The San <br />Miguel County District Court in December 2005 gave PSCo exclusive possession of the <br />described easement, denying us access to ow property without their permission. PSCo <br />has since modified their easement description petition twice, and has indicated that an <br />additional amendment is forthcoming. Until the Judge heazs the case, we won't fully <br />know the limits for ow access. <br />
