7. CDMMENTS (cont.) <br /> There is one small .parcel west of the railroad tracks that remains <br /> urmined, 2.12 acres ±. The reclamation plan calls for the pit to be <br /> backfilled. The landowner has indicated they may wish to fill the <br /> property to approximately level with the railroad along one side of the <br /> pit. We are still filling the pit at this time and will continue to do <br /> that until the landowner is satisfied or material is no longer available <br /> for fill. We are approximately two-thirds (2/3) of the way complete with <br /> filling. Because the entire area is being filled no revegetation can be <br /> done at this time. When fill is complete topsoil will be spread according <br /> to the approved plan and the area will be revegetated. The map attached <br /> shows the area being filled. <br /> In August, 1991 we met the Adams County Planning Department' s Ms. Cindy <br /> Bosco and Ms. Anne Bockenkamp. In this meeting we discussed the filling <br /> at this site and their position on that plan. The counties position is <br /> that as long at the pit has a MLM permit then they will not require a <br /> Certificate of Designation for filling a mine with Inert Materiel as <br /> defined in the State Health Department regulations, i.e. Concrete, dirt, <br /> old asphalt, etc. <br />
