RE: May Day Mine, Permit No. M-81-185, Annual Fee and Report, Notice of Violation
No. M-96-018, Civil Penalties, and Cease and Desist Order
Dear Mr. Ferguson:
C.R.S. 34-32-116(3) and (4), 1989 Supp. and Permit No. M-81-185 require you to submit
to the Division of Minerals and Geology $225.00 in annual fees and an annual report on
• or before September 5 of each year. As of the date of this letter the Division has not
received your annual fee and report for September 5, 1995. Therefore, you are in
violation of the above cited statute and the provisions of Permit No. M-81-185. Purs
to C.R.S. 34-32-124 the Mined Land Reclamation Board hereby assesses Notice of
Violation No. M-96-018, Civil Penalties in the amount of $225.00, and Notice and O
to Cease and Desist from ALL mining related activities associated with Permit No.
M-81-185.
NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO
ANY OPERATOR WHO IS CURRENTLY FOUND TO BE IN VIOLATION IN THIS
STATUTE (C.R.S. 34-32-120) UNTIL THE VIOLATION IS ABATED.

If you fail to submit your annual fee, annual report, and the Civil Penalties assessed to
the Division by 5:00 p.m. June 24, 1996, this matter will be heard at a Formal Public
Hearing before the Mined Land Reclamation Board for consideration of permit
revocation and forfeiture of your financial warranty Certificate of Deposit No. 10725 in
the amount of $5,000.00, at the June 26-27, 1996 Board meeting. If you submit all past
due annual fees, reports, and the Civil Penalties by 5:00 p.m. June 24, 1996, this matter
will be withdrawn from Board consideration.
IN ORDER TO AVOID PERMIT REVOCATION AND BOND FORFEITURE, PLEASE
SUBMIT $225.00 FOR ANNUAL FEES DUE AND $225.00 FOR CIVIL PENALTIES
